Contract Issues, Grievances and Arbitrations


GRIEVANCES/ ARBITRATIONS/ ISSUES as of THURS. OCT. 1, 2009

 

TELUS Hot Edict ( Struck work) clause: Following a long and arduous trip through the courts The Guild successfully defended its contract language and was awarded court costs in both the Judicial Review and the Judicial Review Appeal launched by the Company. The total court costs awarded to the Guild = $22,000. which the Guild has set aside to put towards the Arbitration that had been put in abeyance until the Company had exhausted its legal manoeuvres. Dates set for April 28, 29, 30 2010 with Arbitrator Rod Germaine.

Editorial Assistant reclassification: position has changed in its core functions; complexity; responsibility and accountability. Grievance committed to Arbitration. Awaiting the selection of Arbitrator and dates.

Dress Code Policy and Reader Sales and Service Memo: The Company conceded that the issue of wearing jeans was addressed in the 1991 Dress Code Arbitration wherein it was decided that jeans could be worn by reporters in the field and those employees in the Circulation dept. who deliver newspapers. The issue between the parties is the policy ban on the wearing of shorts. Grievance committed to Arbitration. Awaiting the selection of Arbitrator and dates.

Pension Plan: awaiting info on upgrade formula used for employees on sabbatical; grievance on issue of employees diverting percentage of wage increase for upgrade and not receiving an upgrade committed to Arbitration.

Letters of warning to 2 desk persons concerning errors made: grievances have been filed with grievance meeting set for Wed. Oct. 7, 2009

Member using some vacation for sick leave (resolved)

Company vacation tracking system for Guild members
